Welcome to Dorsal — Diving & Ocean Adventures ("Dorsal", "we", "us"). These Terms and Conditions govern your use of our website and the purchase of experiences and services offered by Dorsal. By accessing our website or making a booking, you agree to be bound by these terms. Please read them carefully before proceeding.

1. Use of the Website

  • You must be at least 18 years old to make a booking on behalf of yourself or a group. Minors may participate in activities only with a parent or legal guardian's written consent.
  • You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
  • You agree to provide accurate and current information during the booking process.
  • You may not use our website for any unlawful or unauthorised purposes.

2. Bookings

  • A booking is confirmed only upon receipt of full or agreed partial payment and written confirmation from Dorsal.
  • We reserve the right to refuse or cancel any booking at our discretion, including but not limited to cases of product unavailability, pricing errors, or suspected fraudulent activity. In such cases, a full refund will be issued.
  • Participants are required to disclose any relevant medical conditions, physical limitations, or lack of swimming ability prior to booking. Dorsal reserves the right to refuse participation on safety grounds.

3. Bookings & Payment

  • Submitting a booking request does not create a confirmed booking. Your place is reserved only once we reply to confirm availability.
  • Prices shown on the website are indicative. We confirm the final price with you when we respond to your request.
  • No payment is taken through this website. Payment is arranged directly with us and settled in person or by a method agreed with you.

4. Cancellations & Refunds

Cancellations and refunds are governed by our Refund Policy, which forms part of these Terms and Conditions. In summary:

  • Cancellations made more than 3 days before the activity — full refund.
  • Cancellations made 3 days or less before the activity — 50% refund (50% cancellation fee applies).
  • No-shows — no refund.
  • Cancellations by Dorsal due to weather or safety conditions — full refund or reschedule.

5. Health, Safety & Participant Responsibility

  • All participants must follow the safety instructions given by Dorsal guides and instructors at all times.
  • Diving activities carry inherent risks. Participants accept these risks by proceeding with a booking.
  • Dorsal holds the right to remove any participant from an activity at any time if their behaviour poses a risk to themselves or others. No refund will be issued in such cases.
  • Participants must not be under the influence of alcohol or drugs during any activity.
  • A signed liability waiver may be required on the day of the activity as a condition of participation.

6. Activity Schedules & Weather

  • Advertised schedules and meeting times are subject to change due to weather, sea conditions, or operational requirements.
  • Dorsal will make reasonable efforts to notify participants of any changes as early as possible.
  • We shall not be liable for any costs incurred (e.g., travel, accommodation) as a result of activity cancellations or rescheduling beyond our control.

7. Intellectual Property

  • All content on this website — including text, images, logos, and videos — is the property of Dorsal or its licensors and is protected by intellectual property law.
  • You may not reproduce, distribute, or modify any content without our prior written consent.

8. Limitation of Liability

  • To the fullest extent permitted by law, Dorsal shall not be liable for any indirect, incidental, or consequential damages arising from your participation in our activities or use of our website.
  • Our total liability for any claim shall not exceed the amount paid by you for the relevant booking.

9. Privacy

Your use of our website and services is also governed by our Privacy Policy, which forms part of these Terms and Conditions.

10. Governing Law

These Terms and Conditions are governed by the laws of Sri Lanka. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

11. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be published on this page with a revised "last updated" date. Continued use of our website after changes constitutes acceptance of the updated terms.
